These Terms of Service ("Terms") govern your access to and use of the avaTOK websites, apps, and services (the "Services"), provided by AvaGlobal International, Inc. ("AvaGlobal", "AvaTOK", "we", "us", or "our"), a Delaware corporation in the United States. By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility & accounts
You must be able to form a binding contract and meet any minimum age requirements in your jurisdiction. You are responsible for your account, for keeping your credentials secure, and for all activity under your account.
2. Your content
You retain ownership of the content you create or upload. You grant us a limited, worldwide, non-exclusive license to host, store, reproduce, and display your content solely to operate and improve the Services. You are responsible for your content and confirm you have the rights to share it.
3. Acceptable use
You agree to follow our Community Guidelines and not to misuse the Services — including no illegal activity, harassment, infringement, spam, malware, or attempts to disrupt or reverse-engineer the Services.
4. Payments, payouts & fees
Some features let you earn or spend money. Payments and payouts are handled by third-party processors (such as PayPal and Wise) subject to their terms. Applicable fees, revenue shares, and taxes are your responsibility where required by law. We may change pricing with notice.
5. Artificial intelligence — important disclaimer
avaTOK is an AI-centric product, and some features and content are generated or assisted by artificial intelligence. AI can make mistakes. AI-generated outputs may be inaccurate, incomplete, outdated, or otherwise unreliable, and AvaGlobal is not responsible or liable for decisions you make based on them. Always use your own judgment and verify important information independently.
We have made our best efforts to use imagery generated by AI responsibly. If you come across any image or content on avaTOK that you find objectionable, please tell us at support@avatok.ai and we will review and remove it. Any such inclusion was not intentional.
6. Third-party services
The Services may link to or integrate third-party products. We are not responsible for third-party services, and your use of them is governed by their own terms.
7. Intellectual property
The Services, including software, design, and trademarks, are owned by AvaGlobal or its licensors and protected by law. These Terms do not grant you rights to our branding except as needed to use the Services.
8. Termination
You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or to protect the Services and our community. Some provisions survive termination.
9. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or secure.
10. Limitation of liability
To the maximum extent permitted by law, AvaGlobal and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Services.
11. Indemnification
You agree to indemnify and hold AvaGlobal harmless from claims arising out of your content, your use of the Services, or your violation of these Terms or applicable law.
12. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules, except where local mandatory consumer-protection laws apply to you.
13. Changes
We may update these Terms from time to time. We will post the updated version here and revise the "Last updated" date. Continued use after changes means you accept the updated Terms.
